Tax on winnings in the Philippines is a real rule, written into the National Internal Revenue Code, and it reaches prizes and winnings above a set amount at a flat final rate. This page quotes the Code’s sections so you can see the rate, the exemptions and who pulls the tax out before a payout reaches you. It explains the rules for any brand and says nothing about how any single site handles them.

Tax on winnings Philippines: what the Code says

The base rule is Section 24(B)(1), restated by Republic Act No. 10963 (the TRAIN law), which took effect on January 1, 2018. It places a final tax at the rate of twenty percent (20%) on prizes, except prizes of ten thousand pesos (₱10,000) or less, and on other winnings. Section 32(A)(9) separately lists prizes and winnings among the items of gross income.

The sections above do not name casino payouts one by one. Whether a given payout counts as “other winnings” is a question for the Bureau of Internal Revenue, so read its published rulings at bir.gov.ph before you assume either way.

Who withholds the tax

Section 57(A) says the final tax on the listed items of income is withheld by the payor and paid over to the government. For you that means the amount you receive is already net of the tax, and the payor holds the paperwork.

  1. The payor deducts the tax at the moment of payment.
  2. The payor files the final withholding return and pays the tax within twenty-five (25) days from the close of each calendar quarter (Section 58(A)).
  3. On request, the payor furnishes a written statement of the income paid and the tax withheld (Section 58(B)).

Ask for that statement. It is your proof of what was paid and what was taken.

A worked example in pesos

Take a prize of ₱50,000, a figure chosen for this example only. At twenty percent, the tax is ₱10,000, and the net payout is ₱40,000. A prize of exactly ₱10,000 sits on the other side of the line and is taxed under Section 24(A) instead.

Problem

The payout you received is lower than the prize you were told about.

Fix

Check whether a withholding deduction explains the gap: twenty percent of ₱50,000 is ₱10,000, so a ₱40,000 payout fits the rule. Ask the payor for the written statement of tax withheld, and compare it with your round record before you raise a dispute.

Tax on winnings and the rules around it

Tax is one piece of the regulatory picture. The wider PAGCOR regulations behind licensed play cover who may operate and what the games must meet, and the 21-and-over age verification rule explains the check that comes before any payout. The identity documents used in that check are personal data, so your Data Privacy Act rights over your tax ID apply to them.

Before you play at a brand you have just found, check whether a brand is legit against the regulator’s own lists rather than a badge on the page.

Keep records that settle questions

A payout dispute or a tax question is decided on paper, so treat your records as part of the game.

  1. Screenshot each large win with its date and amount.
  2. Save the withholding statement when you ask the payor for it.
  3. Share your Tax Identification Number only through a secured form, because it is personal data.

FAQ

Is there a tax on winnings in the Philippines?

Yes. Section 24(B)(1) of the National Internal Revenue Code, as restated by RA 10963, imposes a final tax of twenty percent (20%) on prizes over ten thousand pesos and on other winnings, with an exception for small Philippine Charity Sweepstakes and Lotto wins.

Who takes the tax out of a win?

Section 57(A) says the final tax on listed items of income is withheld by the payor and paid to the government. You then receive the net amount.

Are small prizes under ₱10,000 taxed?

Section 24(B)(1) sends prizes of ten thousand pesos or less to Section 24(A), the ordinary income tax rates. Winnings of that size from Philippine Charity Sweepstakes and Lotto are exempt.

Saan ko malalaman kung paano tinatrato ang payout ko?

Basahin ang withholding statement na hinihingi mo sa payor, at itanong sa BIR kung saang kategorya pumapasok ang panalo mo. Itago ang record ng bawat round bilang patunay.
