RA 10175 is the law that turns a fake casino page, a spoofed login and a stolen identity into crimes you can report. Its short title in Section 1 is the Cybercrime Prevention Act of 2012, and it was approved on 12 September 2012. Everything below is read from the Act’s own text on lawphil.net, with section numbers as printed.
If you got here after a page that looked like a casino lobby took your login, start by checking the address you typed. The page on typing jili365.com into your browser explains what the address bar shows, and the checks for any legit claim show how to compare a page with a regulator’s own list.
What the Cybercrime Prevention Act makes a crime
Section 4 lists the offences. The ones a fake casino page touches are in the table, with a plain-words example for each.
| Section | Offence | What the text says | Fake casino page example |
|---|---|---|---|
| 4(a)(1) | Illegal access | Access to a computer system without right | Someone logs into your real account with your stolen password |
| 4(a)(6) | Cyber-squatting | Acquiring a domain name in bad faith to profit or mislead, where it is confusingly similar to a registered trademark | A look-alike address that copies a brand name |
| 4(b)(1) | Computer-related forgery | Inputting or altering data so it is treated as authentic, or knowingly using such data to carry out a fraud | A cloned page that passes itself off as a lobby |
| 4(b)(2) | Computer-related fraud | Unauthorized input, alteration or deletion of data, or interference with a system, causing damage with fraudulent intent | A fake cashier that takes your transfer |
| 4(b)(3) | Computer-related identity theft | Intentional acquisition or use of identifying information of another without right | Using the ID photo you uploaded to a fake sign-up |
Section 5 adds aiding, abetting and attempt. Section 6 raises the penalty by one degree for any crime under the Revised Penal Code or a special law when it is committed through information and communications technologies.
RA 10175 penalties in the Act’s own words
Section 8 sets the penalties. For the offences in Sections 4(a) and 4(b), it is imprisonment of prision mayor or a fine of at least PHP 200,000 up to an amount matching the damage done, or both. Misuse of devices under 4(a)(5) carries prision mayor or a fine of not more than PHP 500,000, or both.
Where the offence is against critical infrastructure, Section 8 sets reclusion temporal or a fine of at least PHP 500,000, or both. Section 9 makes a company liable when a person in a leading position commits the acts for its benefit, with a fine of at least double the Section 7 figure up to PHP 10,000,000, as printed.
NBI cybercrime and the PNP: where you report
Section 10 says the National Bureau of Investigation and the Philippine National Police are responsible for enforcing the Act, and that each shall organize a cybercrime unit or center with special investigators. That is the legal basis for reporting a fake casino page to either body.
| Body | Basis in the Act | Contact as read from its own site |
|---|---|---|
| National Bureau of Investigation | Section 10 | Hotline (02) 8523-8231; main office at Filinvest Cyberzone Bay, Diosdado Macapagal Boulevard, Pasay City |
| Philippine National Police | Section 10 | Take the cybercrime unit’s route from pnp.gov.ph |
| Cybercrime Investigation and Coordinating Center | Section 24 | Take its route from cicc.gov.ph |
Section 24 creates the Cybercrime Investigation and Coordinating Center under the Office of the President for policy coordination. Take the current PNP and CICC routes from their own sites, pnp.gov.ph and cicc.gov.ph. Procedures and forms change, so the bodies’ own pages are the place to read them.
Report a fake casino page, step by step
- Stop and keep the page open. Do not enter another password or send another transfer.
- Screenshot the full address bar, the page and the time. Copy the web address as text into a note.
- Save every receipt, reference number and message. Write down the date and time of each payment.
- Change the password of any account that shares the one you typed, and tell your bank or wallet provider.
- Report to the NBI or the PNP cybercrime unit with the folder of evidence. Section 13 requires a service provider to preserve traffic data and subscriber information for a minimum of six months from the transaction, so give exact dates early.
The Act names offences and penalties, and investigators and the court decide each case, so your job is an intact evidence trail. The wider rulebook is on the PAGCOR regulations overview, and ads that push you toward a copy page are explained in reading gambling ads critically.
