Jueteng is a numbers game that Philippine law names, defines and punishes by name. Republic Act No. 9287, approved on 2 April 2004, is the statute that raised the penalties for illegal numbers games, and its Section 2 gives each game a definition. This page is a vocabulary and law reference: it explains what the words mean and what the Act sets as penalties, and nothing on it points you to a game.

All section numbers and figures below are read from the Act’s text on lawphil.net. The wider picture of who may run which kind of gambling sits in the PAGCOR regulations on who may run a game.

Jueteng, masiao and last two as RA 9287 defines them

Section 2(a) defines an illegal numbers game as any form of illegal gambling activity that uses numbers or combinations of them as factors in giving out jackpots. The three named games differ in where the winning combination comes from.

GameSectionHow the Act defines itSource of the winning combination
Jueteng2(b)Combination of 37 numbers against 37 numbers, from 1 to 37, or 38 numbers in some areas; bets placed and accepted per combination, and its variantsThe numbers combination itself, bet per combination
Masiao2(c)Winning combination derived from the last game of Jai Alai or the Special Llave portion, or a fictitious Jai Alai game of ten players, and its variantsAnother game’s result
Last two2(d)Winning combination derived from the last two numbers of the first prize of the winning Sweepstakes ticket in the weekly draw of the Philippine Charity Sweepstakes Office, and its variantsThe PCSO weekly draw’s first prize

Masiao

The word masiao in the Act covers a number game that borrows its result from Jai Alai, including a made-up game of ten players pitted against one another. The Act’s phrase “and its variants” means a changed name does not take a game outside the definition.

Last two

Last two borrows the last two digits of the first prize in the PCSO weekly draw. The PCSO’s own draw is the real event; the Act makes the side bet that copies its result the illegal one.

Why jueteng is illegal and a licensed draw is not

The Act’s Section 1 says the State condemns illegal gambling activities such as illegal numbers games and will adopt stricter measures to eradicate them. The difference is the one the Act’s word “illegal” carries: a draw run by a body the law authorizes is a different thing from a private operation taking bets per combination.

Three questions settle which side of the line a thing is on.

  1. Who runs the draw, and which law authorizes that body? The PCSO and PAGCOR publish their own authority on their own sites.
  2. Is the result produced by that body, or copied from someone else’s result? A copied result is the pattern Section 2(c) and 2(d) describe.
  3. Does a collector, agent or runner take bets for a principal? Section 2(g) describes exactly that role.

How a licence is checked at the regulator’s own list is explained on the checks for any legit claim page.

Jueteng penalties by role under Section 3

Section 3 penalizes anyone who takes part, and sets the term by role. The more responsibility the role carries, the longer the term.

RoleSectionImprisonment
Bettor3(a)30 days to 90 days
Personnel or staff, or a person who lets a vehicle, house, building or land be used3(b)6 years and 1 day to 8 years
Collector or agent3(c)8 years and 1 day to 10 years
Coordinator, controller or supervisor3(d)10 years and 1 day to 12 years
Maintainer, manager or operator3(e)12 years and 1 day to 14 years (the printed text carries a stray “ten (10)” before “fourteen (14)”)
Financier or capitalist3(f)14 years and 1 day to 16 years
Protector or coddler3(g)16 years and 1 day to 20 years

Section 5 sets 12 years and 1 day to 20 years and a fine of PHP 3,000,000 to PHP 5,000,000 for a government employee or public official in the collector-to-financier roles, with perpetual disqualification from public office. Section 6 sets 6 months and 1 day to 1 year or a fine of PHP 100,000 to PHP 400,000 for a parent or guardian who induces a minor, ward or incapacitated person into an offence, with loss of authority over that person.

What else the Act provides

SectionProvision
4Possession of gambling paraphernalia is prima facie evidence of an offence
7A repeat offender gets the penalty next higher in degree
8Immunity from prosecution for a government witness, under the stated conditions
9Forfeiture of proceeds and property used in the operation
10Witness Protection Program for a person giving material information
11Informer’s reward, set by DOJ guidelines with the DILG and NAPOLCOM

Ads that dress up an unlicensed game as a harmless pastime are explained in reading gambling ads critically. A fair casino game, by contrast, is one whose rules and results a testing body has checked, as set out in how game testing works.
